- Businesses where employees are organized in labor unions may face additional requirements when it comes to monitoring employees. The National Labor Relations Board states that video surveillance in the workplace is an issue that must be addressed in collective bargaining agreements between unions and employers before the employer begins surveillance. For this reason, businesses considering the use of video surveillance must coordinate with union leaders before installing surveillance technology. The other sticky situation comes up when employees in a business are considering organizing. The NLRB publishes guidelines on what types of actions employers may take during this sensitive time period to ensure that business leaders do not interfere with, restrain, or coerce employees in the exercise of their rights.
