Filing a trademark
So you're ready to file a trademark. You've done what you need to be sure that you're not going to get sued for infringement by some prior user. You're sure you're going to move forward with this product. Where do you file? There's actually a variety of ways you can file a trademark application. You can actually file in your state. It's pretty rare that businesses actually use this anymore, but for a very small fee, you can file a trademark application in any of the 50 states. You can also file a trademark application with the federal government. This is the U.S. Patent and Trademark Office; it's the USPTO. Their website is USPTO.gov There is a means to file online. It's inexpensive, the fee is $275 if you use their predetermined forms. And the process takes 12 to 24 months, depending on whether there's objections and things like that.
